The NCAA and the Professional and Ethical Responsibilities of Lawyers

The NCAA is a private association of universities that governs the conduct of its member institutions, their staffs, and student-athletes.   Its organizational structure and administration has import for the competent representation of coaches, students, and universities charged with NCAA violations or challenging NCAA decisions.  Its enforcement processes differ from traditional trials and, in salient ways, from ADR processes, again raising serious issues for competent representation as well ethical issues such as identifying the client, potential conflicts of representation, and impact of NCAA proceedings on related civil and criminal trials.  In this CLE presentation I describe the NCAA structure, rule-making and dispute-resolution processes as foundation for discussing the role and responsibilities of lawyers in these processes.

Professor Josephine Potuto joined the faculty in 1974. She currently teaches Federal Jurisdiction, Constitutional Law, Sports Law, and Criminal Procedure. She also maintains a special interest in Conflict of Laws and Appellate Advocacy and, among other courses, has taught Mass Communications, Civil Procedure, Contract and Criminal Law.
