9:00 am     Impact of the ADA on Persons With Disabilities
The first portion of this course examines the impact of this law on persons with disabilities. Who are the members of this class? What are the harms they experienced prior to passage of the ADA and how were these individuals disadvantaged when compared with the remainder of American society? How was the Act designed to mitigate discrimination against persons with disabilities? The Act was adopted for the express purpose of levelling the playing field for persons with disabilities in all areas of life, including but not limited to: employment; housing; education; institutionalization; communication, written and verbal; transportation; voting; and healthcare services.

  • Sutton v. United Air Lines, Inc., 527 U.S. 471 (1999) and its companion cases have a remarkably chilling impact on the definition of “qualified person with a disability.”
  • Toyota Motor Manufacturing, Kentucky, Inc. v. Williams, 534 U.S. 184 (2002) paralyze the act even further.
  • ADA Amendments Act of 2008—the ADAAA.
  • Redefining qualified persons with disabilities.
  • Examining the obligation to mitigate on the part of a person with a disability.

  11:15 am    What Entities Were Charged With the Responsibility to Modify Their Behavior as a Result of the Implementation of the ADA?
This portion of the program with examine the ADA from the perspective of those persons, entitites and  organizations whose behavior is targeted. For example, does a diverse work force include employees with disabilities; what is an invisible disability; what is the impact on the rest of the workforce if someone with a highly visible disability is hired; what is the definition of a place of public accommodation; and are thereservices that must be provided in addition to the physical modifications?

Christine Boone has practiced law in the areas of civil rights, disability access, labor & employment, Social Security and preventive law for the hospitality industry. Ms. Boone has also administered a 24/7 comprehensive adult rehabilitation and training center, served as Bureau Chief for the Pennsylvania Department of Labor & Industry, worked as corporate counsel, state’s attorney and school superintendent. Ms. Boone has provided compliance reviews under the Americans With Disabilities Act for some of the Country’s leading resorts and hotel chains, and prepared innumerable winning arguments for State Civil Rights agencies. She served as counsel for both a general vocational rehabilitation agency and a separate agency for the blind, and prepared work for the Pennsylvania Office of Equal Opportunity. Ms. Boone received her Juris Doctor from Creighton University School of Law.
