Supreme Court Ruling

On Friday, December 6th, the Supreme Court issued its opinion In Re Petition for a Rule Change to Create a Voluntary State Bar of Nebraska. The Court ruled that the State may require a lawyer to be a member of a mandatory or unified bar and pay a compulsory assessment. As stated in the opinion, every lawyer must pay a mandatory “bar admissions assessment”. The NSBA has sent a letter to each member , notifying them of the Court’s mandatory assessment. This assessment will pay for the Court’s expenses for admissions, lawyer discipline, and the Commission on the Unauthorized Practice of Law. Effective January 1, 2014 no portion of the “bar admissions assessment” will be available to fund any activities of the NSBA.

The Court noted that members may elect to pay voluntary dues to fund the operation and activities of the Bar Association. The NSBA Executive Council strongly encourages you to join them in paying the voluntary dues. The sum of the new “bar admissions assessment” and the voluntary dues is the same as the amount set forth in the dues statement you have already received. As the Court’s opinion states, voluntary dues are necessary to fund the operation of the Association and the Association’s “many laudable and worthwhile programs which have served the legal profession well.”   For complete information, please read the letter sent to all NSBA members.
