SECRETARY OF STATE ANNOUNCE CHANGES TO THEIR STRUCTURE AND SERVICES
A much improved version of The Nebraska Administrative Code (state
agency Rules and Regulations) is now available on the internet. The
new version is text searchable and complete. You may access the new
rules and regulations on the internet at http://www.sos.state.ne.us/local/regsearch
There is no charge for this service.
In addition, the Secretary of State's Office has merged the operations
of its Corporate and Business filing office, Uniform Commercial Code
Division, and Notary Division into the "Business Services Division".
The Business Services Division is located in room 1301 of the Nebraska
State Capitol. You may continue to use current phone numbers and mailing
addresses for all correspondence with the Corporate, Uniform Commercial
Code and Notary subdivisions of Business Services until further notice.

NSBA office by 5:00 p.m. on August 13, 2003. A number of races are uncontested.

TEST YOUR KNOWLEDGE OF PROFESSIONAL LIABILITY INSURANCE
1. All former members of the firm are covered by my policy even
after they have left the firm.
FALSE. Again, a majority of the insurance companies do provide this
protection to policyholders. There are a few companies offering coverage
in Nebraska that provide this coverage ONLY if the former member of
the firm is no longer engaged in private practice. This means that if
a firm has associates or partners who have left the law firm for another
firm or to start their own practices, it is possible that the departing
lawyer would not have continued individual coverage for acts on behalf
of his former firm. Why is this important? Many new practices are written
without prior acts coverage. If the former firm doesn't continue to
cover the former employee for his/her individual acts on their behalf
and the individual policy doesn't, a gap in coverage exists for the
individual. As the market shifts to more restrictive underwriting not
all attorneys will automatically be provided prior acts.
2. My paralegal and secretary are also covered for the work they
perform.
TRUE. After reviewing most of the Lawyers' Professional Liability policy
offered in Nebraska we did not find any case of this being excluded
from the policy. All of the policies reviewed did make it clear that
this coverage is for the work they perform in the scope of their regular
employment with the law firm. Risk managers advise that the processes
of the firm should be set up to allow the attorney to review and approve
all work of subordinates. Please note that employment by the law firm
is required. Independent contractors would not have individual coverage
under the firm's policy.

CASEMAKER TIP#11: HOW CAN I ACCESS AND SAVE A SINGLE RULE?
It was mentioned in a previous tip that it was not possible to print
or load a single rule from the various rules 'books' even though when
you used the browse function it took you directly to the rule chosen.
There is a workaround. You can use the select, cut, and paste technique
described in Tip #10.
Place the cursor just in front of the text you wish to copy and using
the mouse, left click and hold, drag all the way to the right and then
down until all the text you want is selected(highlighted). Release the
mouse and copy the selected text, ctrl-C. You can paste into a word
processing document, re-format to your preference, print, and/or save
for use now or in the future.

PRACTICE TIP-CONFIDENTIALITY
Practice management advisors from bar associations and law societies
(in Canada) make numerous visits to law practices to help lawyers in
the management of their practices. One issue that frequently arises
is the confidentiality of client information. If you are in an office
sharing arrangement, you should take overt steps to ensure that persons
not associated with your practice do not have access to your files or
other client information. Client files must remain confidential, and
that confidentiality does not extend to other lawyers or non-lawyers
sharing your suite. Lock your office door when you're out of the office.
Remember to do the same with the files on your secretary's workstation
or in file cabinets in a public area. Also, if you share a receptionist,
be sure to periodically remind him or her not to discuss your business
or your clients with others sharing the suite.
