LABOR AND EMPLOYMENT LAW SECTION SEMINAR

"HIPAA" is more than just portability of insurance coverages. HIPAA is also a pervasive national privacy mandate. It will affect lawyers and law firms directly. (Do you have a group health plan? Have you tried to issue a subpoena for health records? Have you been asked to sign a "business associate agreement?") It will also have a major impact on many of our clients and, therefore, on how we represent them. Which clients are affected? The "covered" list is diverse --health care providers, the corner drugstore, school districts, municipalities, insurance companies, billing services, any employer with a group health plan and any individual with a health record. This session will focus on HIPAA from the practicing lawyer's perspective and describe how HIPAA works and to whom HIPAA applies. It will offer a starting point for analyzing HIPAA issues and provide resources and suggestions for dealing with the HIPAA issues lawyers are most likely to encounter.

The speaker is Alexander (Kelly) M. Clarke
