SUPREME COURT RULE CHANGE
Attorney Admission Rule
May 13, 2004 -- amendments to the Nebraska Supreme Court Rules for
Admission of Attorneys, 5 and 16: Added the phrase active and
in good
standing to classification of applicants criteria and added scaled
score
to the passing standards for the MBE and MEE.

Supreme Court Rule For Comment:
Adopt Rules of Professional Conduct and repeal the Code of Professional
Responsibility Deadline for comment: July 16, 2004.
The NSBA petitioned requesting the Nebraska Supreme Court to adopt
proposed
Nebraska Rules of Professional Conduct and repeal Nebraskas Code
of
Professional Responsibility. Proposed rules are modeled after the ABA
Model
Rules of Professional Conduct, with deletions or additions proposed
by the
NSBA Ethics Subcommittee. The proposed rules have been adopted by the
NSBA
Ethics Committee, Executive Council, and House of Delegates. (Case No.
S-36-040001)

COURT INFORMATION AVAILABLE ONLINE THROUGH JUSTICE
Nebraska county and district court information is now available on
the World Wide Web through the JUSTICE system. Case records from 185
of the state's 186 courts can be obtained electronically through Nebrask@
Online, the state of Nebraska's official Web portal. The system was
launched this January and is a collaborative effort with the State Court
Administrator and the Nebraska Supreme Court.
JUSTICE is an online trial courts case search system that allows users
to search for court records from most of the Nebraska State Trial Court's
cases. More than four million case records from all 93 county courts
and 92 district courts can be searched quickly and easily with the JUSTICE
system. Douglas County District Court information is the only jurisdiction
without electronic access - these records must be obtained directly
from the court.
The JUSTICE system provides users with all available public information
about a case as entered by court staff. This information includes, but
is not limited to:
· Case Detail, such as the date and outcome of the trial, the
case type, and presiding judge;
· Party Listing, including the plaintiff and defendant, and sometimes
the associated attorneys;
· Court Cost Information, including all fees associated with
the case;
· Payments by and to the Court; and
· Register of Actions, so users can follow with the proceedings
of the case up to, during, and after the case (assuming it has already
been recorded).
Access to the JUSTICE system is available via a $50 annual subscription
to Nebrask@ Online. This subscription also provides access to a wide
variety of online state services, including driving and motor vehicle
records and corporation and Uniform Commercial Code information. JUSTICE
name searches, which deliver a list of names that match a search, are
available free of charge. Case details are priced at 60 cents per record,
and a $300 per month flat rate option is also available for high-volume
users.

PRACTICE TIP: INVOLVEMENT IS GOOD!
Involve your clients in their legal matters as soon as possible
and as much as possible. The lawyer-client relationship that develops
is much better than those in which the client is not involved. Ask your
clients to draft their own case histories, review documents obtained
in discovery, and participate in the preparation of pre-trial statements.
As a result, clients obtain some appreciation for the amount of time
and type of work involved in preparing their cases, gain some control
over their own cases, understand the effort and skill involved in being
an attorney, and gain a greater sense of trust and appreciation for
your services.

PRACTICE TIP: A LITTLE THING CAN MAKE A BIG DIFFERENCE
If you send a thank you letter to clients at the end of a matter
(and you should), include a client satisfaction questionnaire. While
a thank you letter speaks volumes, adding a short questionnaire can
help cement client loyalty. It can also help raise negative issues the
client did not raise in person. Even if clients do not respond, they
will be glad you asked for their input.
