This program is a participatory dialogue with the attendees and the co-authors of Chapter 18 of The 2018 Nebraska Probate Manual. Discussions will open a wide-ranging flow of practical questions, experiences, and suggestions addressing specific situations. Through collaborative sharing, attendees of all experience levels will learn to avoid pitfalls as well as drafting and operational techniques to produce effective trust administration. Topics to be discussed will specifically include who can create a trust, validity, funding a trust, and administering trusts with particular focus on certain types of trust assets.


10:30 am   A Primer on Medicaid and Related Long Term Care Issues for Estate Planners
Pamela Epp Olsen, Cline Williams Wright Johnson & Oldfather, LLP

This program is Chapter 12 of the 2018 Nebraska Probate Manual and will provide attendees with an outline of long term care alternatives to Medicaid assistance; a primer on the basic Medicaid quali-fication rules for individuals who may require assistance in paying for their long term care; an overview of the types of spend down and asset  planning options available to those who may need Medicaid assistance in the future; and a discussion of liens, estate recovery, and fair hearings in the context of Medicaid.
