NSBA Health Insurance Consortium and Transitioning to Medicare
Come join us for a free lunch and learn how your firm’s participation in the NSBA’s Health Insurance Consortium can result in more affordable coverage (first 30 minutes). Also, for members who are over or approaching 65 (or with parents approaching 65) come and meet our Medicare specialist, Millard Benefits, who will be providing members with no-cost services including Medicare Supplemental cost comparisons, product options like Medicare Advantage (where available), annual prescription drug cost reviews, and education on other products to provide peace of mind for seniors (last 30 minutes). This CLE provides new and seasoned lawyers a review of ethics rules, general substantive law, procedure, and practical advice for assisting self-represented persons at a walk-in self-help center, legal advice clinic, and Nebraska Free Legal Answers {virtual limited advice clinic}.

1:00 pm      The Ethics of Assisting Self Represented Litigants
Laurel Heer Dale, Director of the Nebraska State Bar Association Volunteer Lawyers Project

This session will discuss the Nebraska Rules of Professional Conduct governing nonprofit and court-annexed limited legal services programs. It will include a review of the Preamble to the Rules and review of Rule 3-506.1, Rule 3-506.5, Rule3-501.7, Rule 3-501.9(a), and Rule 3-501.10.

1:15 pm     Debtor Issues
Lea Wroblewski, Managing Attorney, Legal Aid of Nebraska

This session provides an overview of common issues involving debtors and resources available to self-represented litigants, including an interactive website for debtors hosted by Legal Aid of Nebraska.

2:00 pm      Divorce
Michelle Mitchell, Managing Attorney, Legal Aid of Nebraska

This session provides a brief overview of the requirements to file an uncontested divorce using self-help forms and a brief discussion of common issues involving use of self-help forms. Participants will learn about alternatives to divorce, including annulment and legal separation. This session will review ethical issues encountered in assisting self-represented litigants on this issue.

3:00 pm      Establishments of Paternity, Custody, Parenting Time & Child Support
Michelle Mitchell, Managing Attorney, Legal Aid of Nebraska

This session will review resources available to assist self-represented persons in paternity, custody, modification and enforcement actions involving minor children. The speaker will discuss the Nebraska Child Support guidelines, Nebraska Child Support calculator, types of child custody and parenting plans. This session will inform participants about modification of orders and the self-help forms. It will also revew the enforcement process for child support and parenting time.

This session will review ethical issues encountered assisting self-represented litigants on this issue.

3:45 pm      Protection Orders
Michelle Mitchell, Managing Attorney, Legal Aid of Nebraska

This session will discuss the three types of protection orders: Domestic Abuse Protection Order, Harassment Protection Order, Sexual Assault Protection Order, including understanding the requirements and procedural process of each.

This session will review ethical issues encountered assisting self-represented litigants on this issue.

 

4:05 pm      Tenant Issues
Shawn Farritor, Managing Attorney, Legal Aid of Nebraska

This session will provide and overview of the Nebraska Landlord Tenant Act, tenant and landlord responsibilities, the eviction process, and resources available to self-represented persons, including an interactive website hosted by Legal Aid of Nebraska.

Shirley Peng,  Managing Attorney, Legal Aid of Nebraska

This session will provide an overview of FEMA, the assistance through FEMA and the process for applying for FEMA benefi ts, including appealing denials of assistance. Participants will also learn about resources available to victims of disaster.
