12:30 p.m. – 1:15 p.m. What Resilient Lawyers Do Differently

Our protection against stress, adversity, loss, and disruption in our lives is called resiliency. When our resiliency is diminished, we are more likely to be impacted by mental health disorders, turn to unhealthy behaviors (excessive alcohol consumption, drug use, problem gambling), find stress overwhelming and have less satisfaction in our lives. This program will examine the common personality traits found in lawyers and how those traits can impact resiliency. We will then turn to strategies to strengthen resiliency and lawyer wellbeing based on the most recent research.

Succession Planning for Lawyers – Nebraska Style

At some point, our time as practicing attorneys – and as occupants of this planet – is going to come to an end. For some, those two distinct end points may occur simultaneously. A review of the American Bar Association’s past positions on attorney duties in contemplation of death focused almost entirely on the sole practitioner. As attorneys, our obligations of Competence (ABA Rule 1.1) and Diligence (ABA Rule 1.3) are significantly challenged if we reach these distinct end points without a succession plan for our legal practice. The ABA, a majority of states, many insurance companies, and multiple complementary organizations to our legal practice have established requirements around Succession Planning for all lawyers. Today, the Nebraska Supreme Court considers revisions to Neb. Ct. R. § 3-803(K) that would require annual confirmation of a “Designated Attorney” for solo practitioners and an attorney, partnership, corporation, or limited liability organization designee for each partnership, corporation, or limited liability organization consisting of more than one attorney. Join us as we discuss the rationale behind this course of action, the role of ABA and NSBA rules in requiring the “Designated Attorney” in Nebraska, ancillary industry positions on the subject of succession planning for lawyers, and some examples of this rule in practice in several surrounding states (Colorado and Missouri).
