Longtime Director of the Nebraska Lawyers Assistance Program, Rick Allan will be retiring this summer. The Nebraska Lawyers Assistance Program (NLAP) offers help to lawyers, judges and law students troubled by substance abuse problems, stress, depression and other types of disorders, accidents, illnesses, including aging that may impair their ability to perform in a competent and professional manner. NLAP was created for this purpose in 1995 by the NSBA: and the director and volunteers of NLAP, who are members of the NSBA’s Committee on the Nebraska Lawyers Assistance Program, know the problems faced by their impaired colleagues and how to help overcome these problems assisting lawyers, judges, law students, their families and staffs and the importance of protecting the public and the reputation of the Bar and Judiciary. Proposed Rule Amendments: Notice of Comment Period
Competence Section of the Nebraska Rules of Professional Conduct
On March 21, 2017, the Nebraska State Bar Association submitted to the Nebraska Supreme Court a proposed amendment to Comment  of Neb. Ct. R. of Prof. Cond. § 3-501.1, which section is entitled “Competence.” The Nebraska Supreme Court directed that the proposed amendment be published for a public comment period. Full Notice
Notice Of Reappointment Of Incumbent Magistrate Judge
The current term of the office of United States Magistrate Judge Cheryl R. Zwart, who is stationed in Lincoln, Nebraska, expires on January 14, 2018. The United States District Court for the District of Nebraska is required by law to establish a panel of citizens to consider the reappointment of the magistrate judge to a new eight-year term. Legal Advertising Blows Past $1 Billion and Goes Viral

Morris Bart remembers a time when he was awkward, stiff and nervous on camera. It was 1980, and the Tennessee native turned New Orleans resident was building up his personal injury law practice.
It had been three years since the U.S. Supreme Court held in Bates v. State Bar of Arizona that the traditional ban on lawyer advertising was unconstitutional. States were starting to carve out their own ethical rules that covered how attorneys could (and could not) market their services to the general public. Full Article

A day after I was officially called to the bar, I received very different greetings from two lawyers.
The first lawyer—a family friend who had been practicing for 15 years, welcomed me to the profession, and offered me her sincere congratulations. The second—a battle-weary litigator who had spent the last 40 years in the courtroom—offered his condolences. Admittedly, I was far more intrigued by the condolence call than the congratulatory one.

Young Lawyers: Build Good Practice Habits and Avoid Malpractice Claims

You are just beginning to build the habits that can help or hinder your practice in the long term. Consistency in how you deliver service—from the questions you ask at intake to the steps you take when the client leaves the office—is one of the foundations to protect yourself against malpractice claims. Simple procedures, like asking the right questions in an intake form, and calendaring and tickling deadlines and court dates as soon as you know them, are hallmarks of good practice habits. On the other hand, haphazardly going through every client interview or thinking anew about the steps you should take on similar legal issues is a recipe for disaster. The experienced lawyer may not, by virtue of experience alone, be a better lawyer. But the lawyer with experience built on good practice habits is likely better prepared to weather the ups and downs of practice. Best lay the groundwork now. Identify and adopt good practice habits.
