Summary

Most tribal members do not live on reservationsthey live in urban areas throughout the country. In Nebraska, both the Omaha and Winnebago tribes have lots of trust lands, subject to special federal regulations. During the last 10 years or so, more and more tribal members have decided to seek legal assistance with writing a will. Any lawyer writing wills should be familiar with the special considerations involved in writing wills for tribal members. Members of many different tribes own trust land. All of that land is subject to extensive regulation under the provisions of AIPRA, (American Indian Probate Reform Act). AIPRA provides that in most cases trust land can be devised only to an eligible heir, as defined by AIPRA.
