NSBA Legislative Program

For lawyers, staying current on changes to the law—and ensuring the profession’s voice is heard in the legislative process—is essential. The NSBA Legislative Program supports both goals by keeping members informed and by advancing the legal profession’s expertise in shaping Nebraska law.

Keeping Members Informed

The Legislative Program helps members stay up to date on proposed and enacted laws.

  • NSBA Legislative Counsel reviews every bill introduced in the Nebraska Legislature.
  • Each year, 100–120 bills are identified as relevant to practice areas or the profession.
  • Summaries are organized by topic (e.g., family law, business law, probate, juvenile law) so members can quickly find what matters to them.
  • The NSBA Practice Tracker and legislative updates provide timely information throughout each legislative session.
  • NSBA Legislative Counsel provides regular updates through CLE for a number of sections of the NSBA annually.

These tools make it easier for members to monitor developments that impact their work and clients.

Serving the Public

NSBA members play a critical role in improving the law and protecting the public.

  • The NSBA advocates for a strong and effective court system, including supporting judicial resources, merit selection, and access to justice.
  • It has helped establish key initiatives such as the Judicial Resources Commission and funding for civil legal services.
  • Member expertise helps prevent unintended consequences in legislation and ensures laws function as intended.

This work strengthens Nebraska’s legal system and promotes fair, accessible legal services for all.

Supporting the Profession

The Legislative Program also protects and advances the interests of Nebraska lawyers.

  • The NSBA monitors and responds to issues in the technical language of legislative bills introduced and gives feedback to legislators on the practical impact bills may have.
  • It advocates on issues affecting the profession, including:

    • Student loan repayment assistance
    • Preventing unauthorized practice of law
    • Maintaining malpractice standards
    • Regulating trust accounts
    • Ensuring legal services are not subject to sales tax
    • Preserving access to legal services
  • The NSBA may also introduce or support legislation that improves legal practice and the administration of justice.

How Positions Are Established

The NSBA Legislative Program and Policy Statement follows a structured, member-driven process to take positions on legislation:

  1. Legislation Committee reviews relevant bills and recommends positions.
  2. Executive Council evaluates recommendations and provides guidance.
  3. House of Delegates makes final decisions after deliberation.

This process ensures that all positions reflect the informed judgment of the profession. The Legislative Program and Policy Statement also provides a process for remaining responsive to developments during the legislative session.
